CENTRE E PREMISES TERMS AND CONDITIONS OF HIRE

  1. BOOKING: This booking form must be completed for all bookings. The person who signs this form will be the Hirer. Any organisation named will     also be considered the Hirer and shall be jointly and severally liable with the person who signs this form.
  2. KEYS: Keys will be made available as advised in the confirmation of your booking.
  3. DEPOSIT: The Hirer will pay a deposit at the time of booking as advised on the booking form. This deposit is non-refundable.
  4. The Hirer will during the period of the hiring be responsible for supervision of the premises, the fabric and the contents, their care, safety from damage however slight and the behaviour of all persons using the premises whatever their capacity including proper supervision of car-parking arrangements so as to avoid danger to members of the public and obstruction of the public highway. The Hirer will not allow intoxicated people to be on the premises. The Hirer should ensure all people on the premises respect our neighbours when leaving the premises.
  5. At the end of hiring the Hirer will ensure the premises and surrounds are left in a clean and tidy condition properly locked and secured unless directed otherwise by authorised representatives of YEH and any contents temporarily removed from their usual positions properly replaced. YEH reserves the right to make an additional charge for breach of these conditions.
  6. CHILD SAFEGUARDING: In the event that the hiring involves the attendance of young or vulnerable persons, the Hirer confirms that there will be in place an appropriate Safeguarding Procedure and that all adults on the premises are aware of this Procedure and abide by it. The Hirer confirms that appropriate Disclosure Barring Service (DBS) checks will be carried out in respect of persons involved with children and vulnerable young people on the premises during the course of the hiring.
  7. PARKING: The hire of the premises does not include the use of parking facilities, except for loading and unloading.
  8. The Hirer shall not use the premises for any purposes other than that described in the Hiring Agreement and shall not sub-hire or use the premises or allow the premises to be used for any unlawful purpose or in any unlawful way, nor do anything to bring on to the premises anything which may endanger the premises or any insurance policies connected with the premises. The Hirer shall not permit more than the maximum number of people as stated on the hire form to be present on the premises.
  9. ALCOHOL: These are not licensed premises and no alcohol can be sold thereon without a temporary licence from the local authority arranged independently or via YEH. Should the Hirer wish to bring drinks onto the premises, written notice must be provided at the time of booking.
  10. SMOKING: The premises and grounds are a No Smoking Zone. Smoking is only allowed in designated smoking areas.
  11. The Hirer undertakes to satisfy any requirements under performing rights for the performing or playing of live or recorded music. Any Hirer who intends to play music or have a live band agrees to inform YEH in writing at the time of booking. The Hirer undertakes to ensure that all noise is kept to a level such that neighbours of the premises are not unduly disturbed. The Hirer agrees in any event to terminate all loud noise on the premises at 11.00pm, unless an extension is previously agreed with YEH.
  12. PUBLIC SAFETY: The Hirer shall comply with all conditions and regulations made in respect of the premises by the Fire Authority, Local Authority, the Magistrate’s Court or otherwise, particularly in connection with any event which includes public dancing or music or other similar public entertainment or stage plays and shall ensure that such events shall not involve the infringement of any copyrights or performing rights.
  13. YEH has the right to instruct that the use of properly trained and certificated door staff are required for the event in the interests of public safety and/or the protection of the premises, which may or may not be a requirement of the licence for the event.
  14. EMERGENCIES: In anticipation of an emergency it is the Hirer’s responsibility to ensure that he knows the location of the First Aid Kit (in the kitchen area), the nearest hospital and the like.
  15. The hirer shall take good care of, and shall not cause any damage or permit any damage to be done to the premises, or any part of the premises or the fixtures, fittings and equipment on the premises or to any part of the building of which the premises form part or any other building or structure within the curtilage of the building. Any damage caused or permitted by the hirer, his/her servants, agents, contractors or any other person resorting to the premises by reason of his/her hire of them shall be made good by YEH at the cost to the hirer and the hirer shall inform the Management of any such damage as soon as practical and the hirer shall confirm it in writing within 24 hours of its discovery. The cost of such damage shall be determined by a director of YEH whose decision shall be final.
  16. The hirer shall be liable for and shall indemnify YEH against all actions, proceedings, claims, damages, charges, costs, expenses whatsoever brought or made against YEH in respect of any damage, theft or loss of property, goods, articles or things placed, deposited, brought into or left upon the premises or other part of the building of which the premises forms a part either by the hirer for his use or by any other person using the premises by reason of his/her hire unless due to the negligence of YEH, their servants or agents.
  17. YEH shall not be liable for any loss due to any industrial action, breakdown of machinery, failure of supply of electricity, leakage of water, fire, Government restrictions or any other circumstances beyond its reasonable control, which may cause the premises or any part thereof to be temporarily closed or the hiring to be interrupted or cancelled, nor for any failure of the hirer to gain access to the premises unless due to negligence of YEH, their servants or agents.
  18. The hirer shall be liable for, and shall indemnify YEH against all actions, proceedings, claims, damages, charges, costs expenses whatsoever brought or made against YEH in respect of any personal injury to or the death of any person arising out of or in the course of the hire of the premises by the hirer, unless due to negligence of YEH, their servants or agents.
  19. Any director, employee or contractor of YEH can refuse the right of entry at any time during the hire period.
  20. The Hirer shall not interfere in any way with the switchboards, electricity or gas fittings, meter fittings or fixtures on the premises.
  21. It is the responsibility of the Hirer to ensure that the electricity supply is appropriate for any equipment used and that any equipment used will not endanger, overload or damage the electricity supply, circuits, wiring, plugs, sockets, switchboards or other equipment.
  22. INSURANCE: The Hirer acknowledges that the loss of any items left unattended is not covered by YEH insurance cover.
  23. CANCELLATION: If the Hirer wishes to cancel, or reduce the time of, the booking less than 28 days before the date of the event the full hire will remain chargeable.
  24. DEPOSITS: Hiring of the premises to non-members or casual users will require a non-refundable deposit at the time of booking.
  25. YEH reserves the right to cancel a booking in the event of the premises being required for use as a polling station, for a parliamentary or local government election or by-election in which case the Hirer shall be entitled to a refund of any deposit already paid.
  26. Even if the Hirer has a regular booking for the hire of the premises, YEH reserves the right to renew, vary or cancel any booking or arrangement on an individual or multiple basis. This right will not be unreasonably enforced.
  27. In the event of the premises or any part thereof being rendered unfit for the use of which it has been hired, YEH shall not be liable to the Hirer for any resulting loss or damage whatsoever.
28. The Hirer shall allow any duly authorised officer of YEH access to the premises or any part thereof at all times during the hiring.
